In 1998, Alaskans approved a ballot measure that legalized the use of medical marijuana. The law did not specifically provide for production, sales and distribution. As a result, there are no medical marijuana dispensaries in Alaska. Then in November 2014, AS 17.38 was passed by a citizen’s initiative to allow for the legal possession, purchase and use of marijuana and marijuana products to all adults over the age of 21. The initiative directs that by mid-2016 the Alcoholic Beverage Control Board is to adopt regulations governing marijuana-related entities and then regulate the newly formed industry.
